Each ticket will cost $25.00 per ticket plus an administration fee of $5.00 per transaction. Your ticket is a receipt for your purchase and represents one opportunity to win the house at 5489 Ahyoka Drive, Lake City, GA. The winner assumes all responsibility for any state, county or federal taxes or fees. Ticket purchases are not tax deductible.
Winning ticket holders need not be present to win.
Ticket sales shall end at 11:59 p.m. on July 2, 2010, unless the deadline is extended and announced by the Because We Care Foundation.
By purchasing a house raffle ticket, winners agree to allow the Because We Care Foundation to release their names and use their likeness to promote the house raffle, or to announce the winners. No compensation will be given for the use of photos or testimonials. Winners will also be listed on this website within 10 days of raffle drawing.
The Because We Care Foundation House Raffle (' Raffle ') begins on December 12, 2009 and ends on July 2, 2010 (' Raffle Period '), unless extended according to the terms contained herein. The Raffle is conducted by the Because We Care Foundation; with a physical address of 2754 Shellbark Rd Suite A Decatur, GA 30035. The Official Rules of the Raffle are set forth herein. By entering the Raffle, Entrants agree to be fully and unconditionally bound by these Official Rules, waive any right to claim ambiguity in the Raffle or these Official Rules and further agree to be bound by the Because We Care Foundation decisions and interpretation of these Official Rules.
The Because We Care Foundation is a 501(c) (3) non-profit organization registered with the Secretary of State of Georgia since 2005. This raffle is for the support of its stated mission of assisting families in the community and educating children.
The Because We Care Foundation is a not for profit organization developed to outreach families in the community and educating children.
The Because We Care Foundation may provide assistance in various ways including, cash, medical, of gifts in kind to organ transplant patients, either before or after surgery, or families of multiples.
The Because We Care Foundation states by ministering to individual needs the quality of one's life will be enhanced encouraged and broadened in order to assist in the development of the future of youth as well as those the youth will come to influence.
1. Eligibility. The Raffle is open to all persons age 18 and over whom are legal U.S. residents physically residing in the United States and DC. Officers, directors and employees of The Because We Care Foundation, its agents, consultants, attorneys, independent accountant firms, and their spouses and children living in the same household and any other persons involved with this promotion are not eligible. The current property owner and children of the current property owner are not eligible to win. The Raffle is subject to all applicable federal, state, and local laws and regulations, and is void wherever prohibited or restricted by law.
2. How to Enter. Raffle tickets (' Tickets ') cost twenty five dollars ($25.00US) each plus and administrative fee of Five dollars ($5.00US) per transaction. Here is how to purchase Tickets and enter the Raffle:

Once an Entrant’s order is processed, the Because We Care Foundation will return the receipt (ticket stub) electronically which will include a Ticket number(s) to the name provided on the Entry Form or to the operator.
A minimum of sixty nine thousand (69,000) tickets will be issued and available for purchase. Any Entry Form and payment received after 12:00 AM EST on July 2, 2010, or any extension thereto announced by the Because We Care Foundation, will be returned. No other refunds will be made, except as otherwise determined by the Because We Care Foundation in its sole discretion.
Subject to availability, Entrants may purchase as many Tickets as they wish. Tickets are personal and can only be in the name of one (1) individual Entrant. Entrants may not sell, donate or otherwise transfer their Ticket(s) to anyone. Prizes will not be issued to anyone other than the one (1) Entrant whose name is on the Entry Form. Title to the property shall be taken in the name as it appears on the Raffle ticket stub and is not transferable or assignable.
The Because We Care Foundation reserves the right to disqualify false entries or entries suspected of being false, and any illegible, defective, incomplete or physically altered Entry Forms and entries that do not include valid or complete payment the Because We Care Foundation is not responsible for printing errors in any Raffle-related material, or for lost, late, misdirected or non-delivered mail or corrupt fax messages, or any other failure to receive orders or deliver receipts prior to the drawing deadlines. All entries become the property of the Because We Care Foundation and will not be returned.
3. Drawings: Grand Prize Drawing: One (1) random drawing will be conducted by a representative of the Because We Care Foundation as described below. This random drawing will be held under the supervision of an independent accounting firm. Entrants need not be present to win. Drawing will be held at 1:00 PM EST on July 04, 2010, or upon the expiration of any announced extension to the Raffle Period at the property, 5489 Ahyoka Dr., Lake City, GA. All participants are invited.
4. Notification. Entrant whose Ticket number is drawn at the Grand Prize Drawing will be deemed the winner of the prize for that particular drawing (' Raffle Winner '). Raffle Winner will be notified by phone and/or U.S. Mail or overnight delivery using the information provided on the Entry Form (' Notification '). If any Raffle Winner cannot be located or fails to return attempts to contact him or her by 5:00 P.M. on the fifth (5) business day after the Because We Care Foundation first attempt to contact him or her, such Raffle Winner will be deemed to have forfeited his or her prize and another Raffle Winner will be drawn. Each Raffle Winner may be asked to send an affidavit of eligibility / liability / publicity release (' Release '). Raffle Winner must provide all information requested to be eligible to win, including proof of age, proof of identity showing that the person claiming the prize is the same Entrant named on the winning Ticket and the winning Ticket stub. Unless restricted by law, each Raffle Winner will be required to complete and return the Release within fourteen (14) days of prize notification. The prize may be forfeited if Raffle Winner: (i) cannot be reached; (ii) fails to obtain all signatures on the Release and to return the documents in a timely manner as required pursuant to these Official Rules; or (iii) cannot accept or receive the prize for any reason. Raffle Winner grants permission for the use of their name, photographs/likenesses for advertising and promotion for this and similar promotions without compensation, unless prohibited by law. 5. Prizes.
Grand Prize: The Grand Prize is the house located at 5489 Ahyoka Dr., Lake City, GA as presented on www. www.upliftinglives09.com:
The Grand Prize Raffle Winner will receive fee simple title to the $650,000.00 (approximate fair market value) ' House ' (Grand Prize) in Lake City, Georgia referenced in all announcements, advertisements, and literature distributed by the Because We Care Foundation Any and all liens and security interests will be satisfied prior to transfer to winner. If less than 60,000 tickets are sold during the raffle period the Because We Care Foundation, may, at its sole discretion, provide an alternate grand prize equal to $10.00 times the number of ticket sold, less expenses and amount of awards of early bird drawings.
The House is provided ' as is ' with no guarantees or warranties from the Because We Care Foundation as to condition, construction, or workmanship. All winners are subject to relevant federal, state and local taxes (including withholdings) and other expenses, including transfer and other real estate expenses, taxes, withholdings, and other transfer fees in connection with any Prize are the sole responsibility of the Raffle Winner.
Notification will be delivered to Raffle Winner by U.S. registered mail or overnight carrier, in the Because We Care Foundation’s sole discretion, to the name and address provided on the Entry form. Notification will be to the name provided on the Entry Form. Raffle Winner will receive an IRS Form 5754 and a W2-G.
6. Proceeds. Proceeds from the Raffle will benefit the Because We Care Foundation and its ongoing charitable purposes in Georgia. Proceeds of the Raffle are for the benefit of the Because We Care Foundation and other participating 501(c) (3) non-profit organizations registered with the Secretary of State of Georgia.
7. Odds. Odds of winning depend on the total number of Raffle Tickets sold.
8. General Conditions. The Raffle is subject to these Official Rules. These Official Rules shall not be changed by any oral statement made by any employee or other person acting on behalf of the Because We Care Foundation By participating, Entrants agree: (i) to be bound by these complete Official Rules and the decisions of the Because We Care Foundation which shall be final and binding; and (ii) to waive any right to claim ambiguity in the Raffle or these Official Rules, except where prohibited by law. By accepting a prize, Raffle Winner agrees to release the Because We Care Foundation, its officers, directors, employees, representatives and agents, and any person or entity associated with the production, judging, or administration of the Raffle (collectively, the ' Releasees ' ) from and against any claims, damages, disability, attorneys’ fees, and costs of litigation and settlement, as well as any liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from redemption, acceptance, possession, ownership, misuse or use of any prize or participation in any Raffle-related activity or participation in this Raffle. Except where prohibited by law, the Raffle Winner’s purchase of a Raffle Ticket and acceptance of a prize constitutes permission for the Because We Care Foundation to use said Raffle Winner’s name, photograph, likeness, statements, biographical information, voice, and city and state address for promotional or advertising purposes in connection with this Raffle on a worldwide basis, and in all forms of media, now or hereafter known, in perpetuity, without review, permission or further compensation. Taxes, if any, are the sole responsibility of Raffle Winner and Raffle Winner will be issued an IRS Form 5754 and W2-G for the Estimated Retail Value of any awarded prize. The Raffle winner is responsible for any applicable taxes, withholdings, and all real estate settlement and closing costs.
The Grand Prize public drawing will be on July 4, 2010, unless extended according to the terms contained herein. If a sufficient number of tickets have not been sold by 12:00 P.M. on June 21, 2010, an alternate raffle period ending date will be determined by the Because We Care Foundation Drawing Location: 5489 Ahyoka Dr., Lake City, GA. Drawing Time: 1:00 P.M. You may attend the drawing.
Each ticket purchaser is advised to consult his or her own tax advisor(s) with respect to the tax liabilities that may arise from winning a prize in this Raffle. the Because We Care Foundation reserves the right to disqualify any entrant it finds to be tampering with the entry process or the operation of the Raffle or violating these Official Rules, and reserves the right to cancel the Raffle should it suspect fraud or for reasons out of the control of The Because We Care Foundation. The Because We Care Foundation shall appoint a single individual who will be responsible for maintaining control and security of the Raffle. Such individual shall, by public certification under oath at the time of the drawing, certify that all Raffle entrants have a stub in the container from which the winning Raffle ticket will be drawn. Disputes regarding these Official Rules and/or this Raffle will be governed by the internal laws of the State of Georgia.
No substitutes for prizes listed. All prizes are subject to Federal and State withholding tax. Winners assume property taxes accrued after closing and subsequently thereafter, all assessments, all local, state and federal the Because We Care Foundation, Income taxes, and title closing costs, if any. Raffle Winner pays title insurance charges. Winner must claim the home on or before within 10 days after drawing. Closing must occur within 30 days after drawing. The Raffle Winner shall pay any and all of the settlement and closing costs of the transfer of title. The Because We Care Foundation reserves the right to extend the raffle date and deadline for ticket sales. The Raffle Winner must claim prize within (10) days of the Raffle drawing date or a new winner will be selected. Winner must go to settlement on the property within (30) days of the Raffle drawing date.
ANY CLAIM OR CONTROVERSY BETWEEN ANY RAFFLE PARTICIPANT AND THE BECAUSE WE CARE FOUNDATION ARISING OUT OF OR RELATING TO THE RAFFLE OR TO THESE RULES AND REGULATIONS SHALL BE SETTLED BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION UNDER ITS COMMERCIAL ARBITRATION RULES, AND JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE RAFFLE MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE RAFFLE. SHOULD SUCH AN ATTEMPT BE MADE THE BECAUSE WE CARE FOUNDATION, RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (THE BECAUSE WE CARE FOUNDATION, INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, THE BECAUSE WE CARE FOUNDATION, INCLUDING CRIMINAL PROSECUTION.
A Raffle Entrant’s sole and exclusive remedy for any claim against the Because We Care Foundation arising out of the sale of raffle tickets or the conduct of the Raffle shall be limited to the return of the purchase price paid for his or her raffle ticket(s). In no event shall the Because We Care Foundation, its directors, officers, employees, agents or representatives be liable to any party for any loss or injury to earnings, profits or goodwill, or for any incidental, special, punitive or consequential damages of any person or entity whether arising in contract, tort or otherwise, even if advised of the possibility of such damages.
If for any reason the raffle is canceled, the Because We Care Foundation must reimburse each Raffle ticket purchaser within sixty (60) days of the Raffle cancellation date but may retain up to 10% of the ticket price for administrative costs. An example of cancellation may be due to insufficient ticket sales by the raffle deadline.
9. Privacy. All personal information collected by the Because We Care Foundation will be used for administration of the Raffle. The Because We Care Foundation, Inc. will not share, sell or otherwise distribute personal information collected by the Because We Care Foundation except as stated above.
10: .Official Rules and Winners List. A list of all prize winners will be posted on the raffle website on or about ten (10) days after the prize has been claimed and a copy of the winners’ list and of these Official Rules may be obtained by sending a self-address, stamped envelope to: The Because We Care Foundation Attn: House Raffle, 2754 Shellbark Rd Suite A Decatur, GA 30035. WA and VT residents need not affix return postage. Requests must be received within 30 days of the close of the Raffle.
11. Registration with the State of Georgia. By license from the Dekalb County Sheriff’s Office, the Because We Care Foundation has obtained authorization to conduct a raffle in Georgia within the year 2010.
